Terms & Conditions
This Terms and Conditions Agreement (“Agreement”) is entered into between Dream Gyrl Travel, LLC (“Company,” “we,” “us,” or “our”) and the undersigned traveler (“Traveler,” “Client,” or “you”). By signing or electronically accepting this Agreement, you acknowledge that you have read, understood, and agree to be bound by all terms and conditions set forth herein.
1. DEFINITIONS
“Supplier” means any third-party provider of travel-related services, including but not limited to airlines, hotels, cruise lines, tour operators, car rental companies, and travel insurance providers.
“Travel Services” means any travel-related services arranged or facilitated by the Company on behalf of the Client.
“Planning Fee” means the non-refundable fee charged by the Company for research, design, and preparation of customized travel proposals.
“Travel Documents” means passports, visas, identification cards, vaccination certificates, insurance policies, and any other documentation required for travel.
2. AGENCY RELATIONSHIP AND SUPPLIER LIABILITY
The Client acknowledges and agrees to the following:
Dream Gyrl Travel, LLC acts solely as an agent for third-party Suppliers and is not the
source, owner, or operator of any Travel Services purchased by the Client.
The Suppliers identified in the Client’s travel documentation are solely and exclusively responsible for providing the Travel Services purchased.
The Client agrees not to hold Dream Gyrl Travel, LLC liable for any Supplier’s: (a) failure to provide contracted Travel Services; (b) failure to comply with any applicable federal, state, or local law or regulation; or (c) negligent act, omission, or misconduct that causes injury, damage, delay, loss, or inconvenience to the Client.
Dream Gyrl Travel, LLC shall not be liable for any injury, loss, damage, accident, delay, or irregularity arising from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, government actions, civil unrest, terrorism, strikes, or pandemics.
3. COVID-19 AND PANDEMIC-RELATED PROVISIONS
Dream Gyrl Travel, LLC has made reasonable inquiry and has provided the Client with the best available information regarding pandemic-protective policies and practices of the relevant Suppliers.
The Client understands that Suppliers may not apply pandemic-protective policies with full consistency, and that other travelers may refuse to comply with such policies, which is beyond the control of Dream Gyrl Travel, LLC.
The Client assumes all risks associated with travel during a pandemic or public health emergency and agrees not to hold Dream Gyrl Travel, LLC liable for any health-related consequences arising from such travel.
4. TRAVEL DOCUMENTS AND IDENTIFICATION
The Client is solely responsible for reviewing all travel documents for accuracy upon receipt and must promptly notify Dream Gyrl Travel, LLC of any discrepancies.
The Transportation Security Administration (TSA) requires all travelers to carry a valid government-issued photo identification to board a flight. The name, date of birth, and gender on the identification must exactly match the information on the airline ticket and booking records. Failure to comply may result in denied boarding or missed flights, for which Dream Gyrl Travel, LLC bears no responsibility.
For international travel, the Client is solely responsible for obtaining and maintaining: (a) a valid passport with at least six (6) months of validity beyond the last date of travel; (b) all required entry and exit visas for each country of destination and transit; (c) required vaccinations, health certificates, and medical documentation; and (d) any travel insurance policies required by the destination country.
The Client agrees to be fully responsible for all costs, losses, or expenses arising from failure to secure or possess proper Travel Documents prior to the departure date.
Passport and visa information may be obtained from the U.S. Department of State at (202) 647-5225 or at travel.state.gov. Non-U.S. passport holders should contact the relevant embassies. Medical information may be obtained from the Centers for Disease Control and Prevention (CDC) at (404) 332-4559 or at www.cdc.gov.
The Client acknowledges that discounted fares typically carry restrictions and that changes to travel arrangements may result in additional charges.
The Client is advised to use a credit card for travel purchases, as this may provide the ability to dispute charges in the event a Supplier ceases operations.
5. POST-PURCHASE PRICE INCREASES
The Client acknowledges that airline tickets, tour packages, and other Travel Services are subject to supplemental price increases after the date of purchase due to additional costs imposed by Suppliers or government authorities, including fuel surcharges, taxes, and foreign exchange fluctuations.
By signing this Agreement, the Client consents to any such post-purchase price increases and expressly authorizes Dream Gyrl Travel, LLC to charge the Client’s credit card on file for such additional amounts, provided that the Company gives the Client reasonable prior written notice of any such increase.
6. PLANNING FEE
A non-refundable travel planning fee is required prior to the commencement of any research or travel proposal preparation. The planning fee amount will be disclosed to the Client in writing prior to acceptance of this Agreement.
The planning fee covers the preparation of up to two (2) customized travel proposals based on the Client’s specified travel preferences.
As a courtesy, the planning fee will be credited toward the Client’s final booking balance upon confirmed booking of Travel Services through Dream Gyrl Travel, LLC.
The planning fee is non-refundable under all circumstances, including but not limited to the Client’s decision not to book travel, dissatisfaction with proposals, or cancellation of the engagement prior to booking.
Additional customized proposals beyond the initial two (2) may be subject to additional fees, which will be disclosed in advance.
7. TRAVEL QUOTES
A travel quote will be prepared and provided to the Client only after all required information has been received, including: traveler personal information (full legal name, address, contact information), travel dates, destination details, budget parameters, insurance preferences, and any special requests.
Travel quotes for domestic travel will be provided within three (3) to five (5) business days of receipt of all required information. Travel quotes for international travel will be provided within five (5) to seven (7) business days.
All quoted prices are subject to change until full payment has been received and confirmed by the Supplier. The Client agrees to review the quote and respond or book with a required deposit within forty-eight (48) to seventy-two (72) hours of receipt of the quote.
Dream Gyrl Travel, LLC is not responsible for any increase or decrease in travel pricing if the Client fails to respond or book within the agreed timeframe.
8. DEPOSITS AND PAYMENTS
The Client is responsible for making all deposits required by the Supplier by the applicable deadline communicated by Dream Gyrl Travel, LLC.
Dream Gyrl Travel, LLC is not responsible for any price increases, loss of reservations, or other consequences resulting from the Client’s failure to make timely deposits or payments.
All payments are subject to the Supplier’s payment terms and conditions, which the Client agrees to review and accept independently.
9. TRAVEL INSURANCE
Dream Gyrl Travel, LLC strongly recommends that all Clients purchase comprehensive travel insurance to protect against risks including, but not limited to, trip cancellation, medical emergencies, supplier bankruptcy, lost baggage, and travel delays.
Dream Gyrl Travel, LLC acts solely as an agent for travel insurance providers and is not the insurer or underwriter of any travel insurance policy.
The Client agrees not to hold Dream Gyrl Travel, LLC liable for any failure by a travel insurance provider to: (a) provide coverage or benefits; (b) comply with applicable law; or (c) process claims in a timely or satisfactory manner.
The Client’s decision to decline travel insurance is made at the Client’s sole risk and expense.
10. CANCELLATIONS AND REFUNDS
All cancellations are subject to the cancellation and refund policies of the applicable Supplier(s). The Client is solely responsible for reading, understanding, and complying with all Supplier cancellation policies prior to booking.
Dream Gyrl Travel, LLC does not issue refunds for any Travel Services. Any refunds, credits, or compensation are solely the responsibility of the Supplier.
The Client must notify Dream Gyrl Travel, LLC of any intent to cancel via email or telephone as soon as possible and no later than the deadline specified in the applicable Supplier’s cancellation policy.
Dream Gyrl Travel, LLC’s planning fee and any applicable service fees are non-refundable regardless of the reason for cancellation.
Dream Gyrl Travel, LLC shall not be held liable for any costs, losses, or damages incurred by the Client as a result of cancellation by the Client, a Supplier, or due to circumstances beyond the Company’s control.
11. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Dream Gyrl Travel, LLC’s total liability to the Client for any claim arising out of or related to this Agreement or the Travel Services shall not exceed the total planning fees and service fees paid by the Client to Dream Gyrl Travel, LLC.
In no event shall Dream Gyrl Travel, LLC be liable for any indirect, incidental, consequential, special, or punitive damages.
12. FORCE MAJEURE
Dream Gyrl Travel, LLC shall not be liable for any failure or delay in performance of its obligations under this Agreement to the extent such failure or delay is caused by circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, epidemics, government travel restrictions, war, terrorism, civil disturbances, strikes, or labor disputes.
13. DISPUTE RESOLUTION AND GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of the State in which Dream Gyrl Travel, LLC is registered, without regard to its conflict of law principles.
Any dispute, claim, or controversy arising out of or relating to this Agreement shall first be submitted to good-faith mediation. If mediation is unsuccessful, the parties agree to resolve disputes through binding arbitration in accordance with the rules of the American Arbitration Association.
The Client waives any right to participate in a class action lawsuit or class-wide arbitration against Dream Gyrl Travel, LLC.
14. INDEMNIFICATION
The Client agrees to indemnify, defend, and hold harmless Dream Gyrl Travel, LLC, its officers, directors, employees, and agents from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) the Client’s breach of this Agreement; (b) the Client’s failure to obtain proper Travel Documents; (c) the Client’s negligent or wrongful acts or omissions; or (d) the Client’s
violation of any applicable law or regulation.
15. SEVERABILITY
If any provision of this Agreement is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
16. ENTIRE AGREEMENT
This Agreement constitutes the entire agreement between the parties with respect to its subject matter and supersedes all prior negotiations, representations, warranties, and understandings of the parties. This Agreement may not be modified except by a written instrument signed by both parties.
17. ACKNOWLEDGMENT AND ACCEPTANCE
By signing or electronically accepting this Agreement, the Client acknowledges that they have read, fully understood, and voluntarily agreed to all terms and conditions set forth herein. The Client further acknowledges that they have had the opportunity to seek independent legal counsel prior to executing this Agreement.
